Terms of Service

Welcome to Sellcurb. These Terms govern your use of the Sellcurb service. By creating an account, publishing a listing, or buying listing credits, you agree to these Terms.

Who we are

Sellcurb is operated by Sellcurb LLC in the United States. Sellcurb is a neighborhood marketplace in San Diego where neighbors sell, buy, and give away household items to each other, and where verified local organizations post Asks for items they need. Listings live on Sellcurb; we do not post them anywhere else.

Accounts

  • Neighbor accountsare for people. A neighbor can list items to sell or give away, buy and claim items, and offer items to an Advocate's Ask.
  • Advocate accounts are for verified local organizations, and are limited to posting Asks and coordinating the pickups that come from them. Advocate accounts cannot list, sell, or buy. We verify Advocates before enabling the account.

One person, one account. Accounts are personal to you; don't share your sign-in link or code with anyone else.

The service

When you list an item on Sellcurb:

  1. You take photos of the item. Sellcurb's AI drafts a title, description, and suggested price from them; you review and can edit all of it before publishing.
  2. Every listing is screened against our Prohibited Items policy when it is created and again when it is published.
  3. Publishing a listing for sale spends one listing credit. Free items and Advocate Asks never use a credit.
  4. Your listing appears in the San Diego marketplace, and interested neighbors message you here on Sellcurb. There are no phone numbers and no email addresses exchanged.
  5. You agree the pickup in the app. The exact pickup location is revealed to the other neighbor only once you have both confirmed the pickup.
  6. After the pickup, both neighbors can rate each other. Ratings are shown on your profile.
  7. A listing stays active for 30 days. Before it lapses we'll nudge you, and you can renew it once for free; after that it is archived, with a further window in which you can bring it back before it expires for good.

Eligibility

You must be at least 18 years old and a United States resident to use Sellcurb. Sellcurb currently serves the San Diego area.

Listing credits

Sellcurb charges for publishing a listing for sale, not for the sale itself. One listing costs $4; credit packs bring the per-listing price down. Giving an item away and posting or fulfilling an Ask are always free.

  • A credit is spent when a listing is published, not when it sells. Credits are non-refundable: they pay for the AI that writes and prices your listing and for the 30 days your item is in front of neighbors — not for a successful sale.
  • Credits you buy do not expire. Promotional or bonus credits may carry an expiry date, which we show you when we grant them.
  • Credits are bought on the web, through Stripe. If you're using the iPhone app, it will hand you off to the web to complete the purchase and return you to where you left off.
  • Credits have no cash value, cannot be transferred between accounts, and cannot be redeemed for anything other than publishing a listing.

What Sellcurb does not do

  • Sellcurb does not process payment for items. Sellcurb charges only for listing credits. Money for the item itself changes hands directly between you and the other neighbor at pickup, in whatever form you two agree to (cash, Venmo, Zelle, and so on). Sellcurb is not a party to that sale and never holds or processes the sale amount.
  • Sellcurb does not guarantee a sale, a specific price, or a specific amount of interest.
  • Sellcurb does not verify neighbor identity. A neighbor account is not checked against any ID. Ratings and reviews are neighbors' own accounts of their experience, not a background check.
  • Advocate verification is not a background check. Advocates are the one kind of account Sellcurb verifies: before an Advocate can post Asks, a person at Sellcurb reviews the organization's application and approves it, and the organization must state that it can coordinate pickups. That review is of the organization's application. Sellcurb does not check identity documents or run background checks, and the review says nothing about the individual staff or volunteers who come to a pickup. Sellcurb can suspend an Advocate's verification. Verification, and the Certified Advocate badge that shows it, is not a promise that a pickup is safe.
  • You are responsible for conducting pickups safely — whether you are meeting a neighbor or an Advocate.
  • Sellcurb does not transport items between locations.
  • Sellcurb does not mediate disputes that arise after pickup.

Your responsibilities

  • Post accurate information about your items. No false claims about condition, authenticity, or legality.
  • List only items you own and are entitled to pass on, and only items allowed by our Prohibited Items policy.
  • Show up. Complete pickups you've agreed to in good faith, and say so promptly if plans change.
  • Handle payment for the item directly and honestly with the other neighbor. Do not deceive anyone about price, condition, or availability.
  • Keep it neighborly in messages, in reviews, and in your listings.
  • Treat what you learn through a pickup — someone's address, their household, their circumstances — as private. Don't reuse it for anything other than the pickup you arranged.

Prohibited conduct

You may not:

  • Use Sellcurb to harass, defraud, or deceive other neighbors, Advocates, or anyone else.
  • Post items that violate federal, state, or local laws, or that our Prohibited Items policy disallows.
  • Create multiple accounts to avoid listing credits, evade a suspension, or manipulate ratings.
  • Misrepresent an organization in order to obtain an Advocate account, or use an Ask to obtain items you intend to resell.
  • Use Sellcurb for bulk commercial reselling; it is built for neighbors passing on household items.
  • Reverse-engineer, scrape, or otherwise abuse the Sellcurb service.

Messages and coordination

Neighbors message each other on Sellcurb. There is no phone number or email address to exchange — coordination stays in the app by design, so a pickup can be arranged without either person handing over contact details.

The exact pickup location is disclosed to the other neighbor only once you've both confirmed the pickup. If you choose to share a live ETA on your way there, it is calculated on your device and only the minutes-away figure is sent — never your location. That share ends automatically; see the Privacy Policy for the details.

Messages, listings, and AI decision records are retained for the period described in the Privacy Policy, for audit, dispute resolution, and AI quality review.

AI-generated content

  • Listing content is drafted by AI from the photos and details you provide. You review and approve it before it publishes, and you are responsible for the accuracy of the final listing.
  • Replies to neighbors may be AI-drafted on your behalf. Anything high-stakes — committing to a price, a pickup time, or a pickup location — waits for your explicit in-app approval before it is sent.
  • AI also screens listings against our Prohibited Items policy. Screening is a safety net, not a guarantee: it does not make a listing legal, safe, or accurate, and it does not relieve you of responsibility for what you post.
  • Sellcurb is not responsible for outcomes resulting from anyone relying on AI-generated listing or message content.

Free items and Advocate Asks

Items given away for free, and items offered to an Advocate's Ask, are gifts between the people involved. Sellcurb does not broker them, does not take a fee, does not value them, and does not issue any receipt or acknowledgment for tax purposes. An Advocate posting an Ask is responsible for its own compliance obligations as an organization.

Reports, enforcement, and appeals

Anyone signed in can report a listing or a neighbor, and a person on our team reviews every report. If we find a violation we may remove the listing and record a strike against the account. Strikes escalate: a warning, then a temporary suspension of listing and messaging, then permanent closure for repeated or serious violations. Serious violations can skip straight to closure. Ordinary strikes fall off after a long stretch with no further violations; strikes for serious violations do not. You can appeal any action by emailing support@sellcurb.com. Unused listing credits are not refunded when an account is suspended or closed for a violation.

Account termination

We may suspend or terminate your account if you violate these Terms or if we reasonably believe your use of the service creates legal or safety risk. You can close your account at any time by contacting support@sellcurb.com.

Disclaimers

Sellcurb is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or uninterrupted.

Limitation of liability

To the fullest extent permitted by law, Sellcurb's total liability to you for any claim arising out of or related to the service is limited to the total fees you have paid in the twelve months preceding the claim. Sellcurb is not liable for indirect, incidental, consequential, or punitive damages.

Privacy

Our collection and use of your information is described in the Privacy Policy.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration will be brought in the state or federal courts located in California.

Changes to these Terms

We may update these Terms. We will post changes on this page and update the “Last updated” date. Your continued use of Sellcurb after changes take effect means you accept the updated Terms.
